What the Service Is

Santa Wishlist is a digital Christmas game offered for entertainment purposes only. A wishlist written in the service is not a real order, not a purchase, and not a promise that anyone will buy anything. We do not deliver any physical gifts.

Who May Use the Service

Anyone may use the service to play.

If a parent or guardian chooses to receive a copy of the wishlist by email, this must be personally entered by a parent or legal guardian who is 18 years of age or older and who confirms this status in the final step.

Children's Privacy & How Wishlist Data Is Handled

The child-facing portions of the Service are designed for entertainment, and we've built it to collect as little as possible from the child using it.

When a letter is delivered to Santa in the story, the wishlist text is sent to our server, analyzed in memory, and immediately discarded. The analysis compares the text against a fixed list of categories, products, and brands, and only structured matches from this list — such as category, product, brand, language, day, and country — are retained as aggregated counters. The wishlist text itself, the child's name, email address, and IP address are never stored, and no individual child or letter can be identified from this data.

If a parent or guardian chooses to receive a copy of the wishlist by email, the wishlist text is sent to our server solely to render and send that one-time email to the address provided. The email is a single, one-time transmission and is not retained or used for any other purpose by Santa Wishlist.

The share-link feature is handled entirely within the child's browser; no wishlist content is transmitted to our server when a share link is created. This applies only to the share-link feature. The email-backup feature works differently: if a parent or guardian later imports the wishlist into wishlist4.com through the recovery link in the email, the wishlist content is then sent to and stored on wishlist4.com's servers, under wishlist4.com's own terms.

If a wishlist is imported into wishlist4.com, it may be kept there as a persistent list (stored in their database) and is subject to wishlist4.com's own retention rules: three (3) months from the latest access of the link, with an automatic extension of three (3) additional months each time the link is opened. Santa Wishlist itself does not store the wishlist in its own database.

If you use our backup feature and enter your email address, a link to our sister site wishlist4.com is created. Through that link, an anonymized copy of the wish list (the child's name is removed) is transferred to wishlist4.com's database. This data is stored according to wishlist4.com's own storage policy: three (3) months from the latest access of the link, with an automatic extension of three (3) additional months at each new access. This applies only to wish lists that use the backup feature, never to lists that are only stored locally in the browser on wishlist4santa.com. How the Service May Be Used

You may not use the service to:

• Write content that is illegal, threatening, abusive, or intentionally harmful
• Enter someone else's email address without their explicit permission
• Attempt to damage, overload, or otherwise misuse the service
• Use automated methods (bots, scrapers) to disrupt the service or circumvent technical limitations.

Misuse & Access Restriction

We reserve the right to restrict or block access to the service, in whole or in part, for users who misuse it — for example through abusive content, automated mass usage, or attempts to disrupt the service. Because the service has no user accounts, such restriction is applied technically (for example by blocking abusive email addresses from the backup feature or throttling abusive traffic) and may be applied without prior notice where necessary to protect the service.

Content You Write

You retain your rights to any text content you create in the service.

Affiliate Links and Commercial Content

The child-facing portion of the service contains no advertising, no sponsored content, and no commercial links.

Wishlists sent via email to parents or guardians may contain links to our adult-oriented partner service, wishlist4.com, which may feature product recommendations and affiliate links. wishlist4santa.com itself contains no commercial links. The email address provided is used solely for the one-time delivery of the wishlist copy and is not retained or used for marketing purposes.

No child's name is transferred to wishlist4.com as part of this process. The recipient-name field is always cleared when a wishlist is imported through the email recovery link.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SANTA WISHLIST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE. WE MAY CHANGE, LIMIT, OR DISCONTINUE PARTS OF THE SERVICE AT ANY TIME WITHOUT NOTICE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SANTA WISHLIST, TOBIAS, OR WEBBVAVAREN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE PROCEEDING.

Governing Law and Jurisdiction

These terms and any disputes arising out of or related to the service shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Sweden, unless mandatory laws in your jurisdiction mandate otherwise for consumers.

We may update these terms as the service evolves. The current version is always available on this page, and material changes are reflected by the "Last updated" date above. Continued use of the service after an update constitutes acceptance of the revised terms.
